Terms of Service
These terms govern your use of Klebby and preserve mandatory EU consumer rights.

1. Parties
Klebby is provided by Emanuel Jose Vargas Luis (ENI, Portugal), Avenida do Atlantico 16, 14º, Escritorio 8, 1990-019 Lisboa, NIF PT233800263. In these terms, Klebby, we, and us mean that controller and service provider. You means the person using the service.
For paid web purchases, Paddle acts as merchant of record. Paddle is the seller for the payment transaction and handles VAT, invoices, payment collection, and payment refunds. Klebby remains responsible for providing the service.
2. The service
Klebby is a visual sticky-note board for web, iOS, and Android. It lets you create notes, arrange boards, tag and filter content, share tags with invited collaborators, comment, receive reminders and notifications, and sync across devices.
Some features are free. Pro features are available through paid plans or a trial, as described on the Pricing page.
3. Accounts and age
You need an account for the app. Provide accurate account information, keep credentials secure, and tell us if you believe your account has been compromised.
Klebby is for users aged 16 or older. Do not use Klebby if you are under 16.
4. Your content
You keep the intellectual-property rights in notes, tags, comments, and other content you add to Klebby.
You grant Klebby a narrow licence to host, store, back up, display, sync, transmit, and share your content only as needed to operate the service, provide support, keep the service secure, and show content to people you choose to share with. This licence ends when the content is deleted, except that deleted content is purged as described in the Privacy Policy's retention section, backups or legal obligations may require temporary retention, and content you shared with others may remain visible to those co-members after you delete your copy or account to the extent they still rely on it.
5. Acceptable use
Use Klebby lawfully and respectfully. Do not use it for illegal content, infringement, harassment, threats, spam, malware, security bypass, service overload, scraping private data, impersonation, or content you have no right to use.
6. Subscriptions, trial, and cancellation
Pro is offered as Annual (€39.99 per year), Monthly (€5.99 per month), and Lifetime founder (€69.99 one time, capped at 300 seats). Prices are shown exclusive of tax; applicable taxes are calculated and shown at checkout by Paddle, as merchant of record, based on your location.
The 14-day Pro trial is cardless. No card is required, there is no auto-charge, and you actively choose a paid plan after the trial if you want to keep Pro. Klebby does not ask you to waive your statutory withdrawal right for the trial.
Annual and Monthly Pro auto-renew unless cancelled before the end of the current paid period. Cancellation takes effect at period end. The Lifetime founder option is a one-time purchase and does not renew.
Lifetime means access to Pro for the operational lifetime of the Klebby service, not a personal-lifetime guarantee; features may change over time; if Klebby is discontinued, reasonable advance notice and a data export will be provided where practicable.
7. Withdrawal and refunds
EU consumers may withdraw from a paid digital-service charge within 14 days without giving any reason. The free trial does not remove that right; a new 14-day period starts when the first paid charge is made after a trial. Klebby does not use a withdrawal waiver.
To withdraw, use the Paddle receipt or manage-purchase link, email support@klebby.com, or use the model withdrawal form in the Refund and Withdrawal Policy. Include the purchase email and enough information to identify the transaction.
On a valid withdrawal, Paddle, as merchant of record, reimburses all payments received without undue delay and no later than 14 days, using the same payment method used for the purchase and at no extra cost to you. Statutory rights for a faulty or not-as-described digital service are not limited.
8. Liability and consumer rights
We provide Klebby with reasonable care and skill. Nothing in these terms excludes or limits liability where the law does not allow it, including intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, or mandatory consumer rights for digital services.
For non-consumer use, Klebby's responsibility is limited to direct, foreseeable loss caused by our breach. We are not responsible for losses caused by your breach, unlawful content, or circumstances outside our reasonable control.
9. Termination
You may stop using Klebby at any time and may request account deletion. We may suspend or close an account only where there is a genuine account, service, or security risk, unlawful use, serious or repeated breach, or non-payment. Where lawful and practicable, we will give notice, explain the reason, and give an opportunity to export your data. If we close an account for a reason other than your breach, any statutory refund or withdrawal treatment still applies.
10. Governing law, changes, and contact
These terms are governed by the laws of Portugal. If you are a consumer, you keep mandatory consumer protections and court rights that apply in your country of residence.
We may update these terms only for a valid reason, for example changes in the law, the service, security, or how the business operates. Changes do not apply retroactively. Material adverse changes are notified in advance by a reasonable means; you may cancel before such a change takes effect, and rights already accrued for a paid period are preserved.
